All citizen's have a Constitutional right to "reasonable bail." The primary consideration is the likelihood that the defendant will attend all future court appearances. At a criminal defendant's first appearance in court on a felony, gross misdemeanor or misdemeanor offense, the judge will determine if bail (for example, $2,000) will be required and what, if any, conditions of release will be ordered, such as no use of alcohol or drugs, or no contact with the victim.
